Placing an order

When you make an order for goods you are accepting the Terms and Conditions of the Bike Scene website.

Full payment of the total price of the goods must be made to Bike Scene before your order can be accepted and the contract between us is formed.

The goods ordered by you will be charged to your credit/debit card at the time of despatch if you have chosen this method of payment, except when a deposit is required to hold goods or in the case of special orders and customisations.

It is our intention to ensure all images, specifications and prices are correct at the time of publication. These may from time to time vary due to alterations made by manufacturers. You will be advised by email or phone of any changes prior to confirmation of your order.

If you do not wish to proceed due to any changes in stated specifications or prices we will of course cancel your order.

We accept no responsibility for incorrect images, specifications and prices.

In the event of a pricing error we shall have the right to refuse or cancel your order whether or not it has been confirmed.

All products are subject to availability. However, we will advise you before confirming your order by email or phone of any out of stock items and the approximate expected restocking date. If you do not wish to proceed we will cancel your order.

Payment

All prices are in pounds sterling and include VAT (VAT Reg. No.: 601925072). We accept payment by most major credit cards, cheque or bank transfer (cheques must be cleared before we despatch your order).

Delivery

Please note: on certain products we do not accept orders or make deliveries to addresses outside the United Kingdom or Eire. Please email us to confirm if we are able to supply the goods you require to an overseas address.

The delivery address for goods paid for by credit/debit cards must be the address registered to the cardholder.

We will always endeavour to deliver goods within the times stated in our purchase procedure. We shall not be liable for any losses, costs, damages or expenses incurred as a result of any delay in delivery of the goods.

As internal damage to packaged goods cannot always be identified on delivery, the customer must sign for the goods as "unchecked". Any visible damage to packaging must also be stated on the drivers delivery sheet.

Any damage identified on inspection of the goods must be advised to Bike Scene within 48 hours of delivery. It is important that all packaging is retained as this may be required for any claims against the carrier. In such circumstances the claim will be dealt with by Bike Scene and we will arrange for collection of the goods and a replacement will be sent. Replacement goods will be despatched upon return of the original goods. Claims for damage outside the above time scale cannot be accepted.

Incorrect Goods

The customer must notify Bike Scene of any goods supplied incorrectly within 48 hours of delivery. The goods must not be used and repackaged in the original packaging to protect them from damage. Bike Scene will arrange for collection of the goods and a replacement will be sent Alternatively we may request that you return small items back to us by post. We will refund your postage costs by crediting your credit/debit card or by issuing a cheque. Replacement goods will be despatched upon return of the original goods.

Returns (Not applicable for faulty goods)

If you are not totally satisfied with your purchase and wish to return it, you must tell us within 14 days (beginning on the day after you receive the goods), and you then have 14 days to return the items for a replacement or refund. Before returning goods please contact us by email or phone. You will then be given a reference which must be enclosed with the returned goods.

Returned goods can only be accepted unused and in perfect condition including all manuals and instructions packaged in the original protective packaging as on delivery. We cannot accept return of goods which have been removed from sealed packaging, goods specially ordered in or orders that have been customised specifically for you.

Carriage costs incurred for the delivery or return of unwanted goods are to be paid for and at the risk of the customer.

On receipt of returned goods in a satisfactory condition, a replacement will be sent or a refund will be paid as soon as possible by the same payment method as used on the original order. Credit card refunds will be re-credited to your account as soon as possible and in any event within 30 days.

Under UK consumer law, consumers may choose to have defective goods or goods which do not conform with the contract of sale either repaired or replaced free of charge. If a repair or replacement is not possible, would impose a disproportionate burden on the seller, or could not be performed in a reasonable time and without significant inconvenience to the consumer, the consumer may choose either to have the price reduced or to withdraw from the contract by returning the product in exchange for a refund. A consumer is entitled to withdraw from the contract by returning a product that does not conform to its contract in exchange for a full refund if the consumer rejects the goods within 30 days. If the product does not conform with the contract after one repair or replacement a consumer is also entitled to exercise a final right of rejection and withdraw from the contract by returning the goods in exchange for a refund. In these circumstances, Specialized (UK) Retail LTD may deduct a reasonable sum in connection with the period of use that the consumer had of the goods. For goods purchased in England or Wales, these rights expire six years from delivery of the goods. For goods purchased in Scotland, these rights expire five years from delivery of the goods. A claim under UK consumer law may be made subject to the defect being present at the time of purchase.

Governing Law

The contract between us shall be governed in accordance with English and Welsh Law and the English and Welsh Courts shall have sole jurisdiction in respect of any dispute between us.

The English language shall be used when making an order and will be used in the contract between us.

Consumer Finance

Specialized (UK) Retail Limited t/a Bikescene is registered in England and Wales No 13792255 We are a credit broker and not a lender. We offer credit products from V12 Retail Finance. Specialized (UK) Retail Limited is authorised and regulated by the Financial Conduct Authority FRN 976130. Credit is subject to age and status.

In the unlikely event, you are still dissatisfied and your agreement is regulated by the FCA, you are entitled to refer your complaint to the Financial Ombudsman Service free of charge. This should be done straight away, but must be within six months from the date of our final response. Further information regarding the Financial Ombudsman Service can be found on their website at www.financial-ombudsman.org.uk.



These terms and conditions are subject to change at any time. Any change will not affect any contract existing between us at the time of the change.
